This website is operated by EveryBod Fitness. These terms constitute a legal document ("the Agreement") which governs your use of this website (“the website / www.everybod.com) and sets out the rights and obligations of you as a purchaser ("you", “your”), and those of EveryBod Fitness ("EveryBod Fitness ", “BOOsT Camp”, “EveryBod Personal Training”, “EveryBod Vitality”, “EveryBod Pilates”, “Forward Steps Running Club”, "we" or "us"), in relation to the services and products offered by us through this site. By registering for EveryBod Fitness services, you acknowledge that any use of the website including any transactions you make (“use/using/place/placing”) is subject to the terms of this Agreement, and you re-affirm that agreement every time you use any of our services.
It is important for both of us that you understand our contractual relationship, please take time to read through these terms and conditions carefully before using this website and before entering into any transaction. Together they represent all the terms and conditions on which we provide you with (i) access to our website; (ii) products and services we may offer on our website and (iii) any orders you may place for our products.
You may wish to print or download a copy for future reference.

Who We Are And How We Operate
EveryBod Fitness is a UK based company and the contract is made under English Law and subject to the jurisdiction of the courts of England and Wales. Some countries will have additional consumer rights based on local law.
EveryBod Fitness can be contacted via the Contact Us webpage on the site, email or telephone +0044 (0)7984 159824 (GMT Time zone). The company is a sole trader, and not VAT registered.
Rebecca Roach is REPS registered (Register Of Exercise Professional - REPS no R0042825) and Forward Steps Running Club is an official Run England, UK Athletics and Race For Life running club.
The Terms & Conditions and transactions including the conclusion of contract are conducted in the English language only. All goods and services supplied directly by EveryBod Fitness are in GBP (£). Where possible both metric and imperial measurements will be included.
1.1 We reserve the right to change these terms and conditions at any time. Any such changes will take effect when posted on the website (see date at the top) and it is your responsibility to read the terms and conditions on each occasion. Your continued use of this website and your continued use of the website shall signify your acceptance to be bound by the latest terms and conditions.
1.2 Certain website services will require registration and subsequent access to those services will be subject to an approved login name (“userid”) and password. Personal information that you provide on this website must be true, accurate, current and complete. The information must relate to you, the person setting up the account / placing the order.
1.2.1 Registered accounts may be withdrawn at our sole discretion and are exclusive to you and non-transferable and must be treated as strictly confidential at all times. Grounds for withdrawal of an account include if you provide any information that is untrue, inaccurate, not current or incomplete or that in any way contravenes our website use policy as set out in clause 7 of these terms. In such circumstances we can also cease supply and refuse you any current and future use of the EveryBod Fitness website and services.
1.2.2 You are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer to prevent unauthorised access to your account. You agree to accept responsibility for all activities that occur under your account or password. You should take all necessary steps to ensure that the password is kept confidential and secure and should inform us immediately if you have any reason to believe that your password has become known to anyone else, or if the password is being, or is likely to be, used in an unauthorised manner. 1.2.3 It is your duty to maintain and promptly update the Registration Data to keep it true, accurate, current and complete. You can access and update much of the information you provided us directly on the website by using the ‘Change Address Details’ form found under the ‘My Account’ option or by contacting our Customer Services as soon as possible.
1.3 EveryBod Fitness is concerned about the safety and privacy of all its users, particularly minors. Please bear in mind that the site is designed to appeal to an adult audience and EveryBod Fitness does not sell products for purchase by children. Accordingly, as legal guardian, it is your responsibility to determine whether the site is appropriate for your child.
1.4 You must not use the website in any way that causes, or is likely to cause, the website or access to it to be interrupted, damaged or impaired in any way. Or do anything that may damage our goodwill or reputation.
1.5 You may not assign or sub-contract any of your rights or obligations under these terms and conditions or any related order for products to any third party unless agreed upon in writing by EveryBod Fitness.
1.6 If any portion of these terms and conditions is held by any competent authority to be invalid or unenforceable in whole or in part, the validity or enforceability of the other sections of these terms and conditions shall not be affected.
1.7 These terms are not intended, nor shall they operate, to create a partnership or joint venture of any kind between us and you.
1.8 In relation to the contract between us and you, no other party shall be entitled to exercise any rights contained in it and the provisions of the Contracts (Rights of Third Parties) Act 1999 are hereby excluded.
2. Placing an Order
All orders that you place on this website will be subject to acceptance in accordance with these terms and conditions.
2.1 The sales contract has three stages to it and completion of the contract does not occur until stage 3.
2.1.1 Stage 1: The display of items on this website is an invitation to treat.
2.1.2 Stage 2: By placing an order you are making an offer that EveryBod Fitness can accept or decline. The 'confirmation' stage sets out the final details of your order. Following this, we will send to you an order acknowledgement email detailing the products you have ordered. Please note that this email is not an order confirmation or order acceptance from EveryBod Fitness. Receipt of payment does not mean that we have accepted an order and we reserve the right to return the payment to you.
2.1.3 Stage 3: Acceptance of your order and the completion of the contract between you and us will take place on despatch to you of the products ordered unless we have notified you that we do not accept your order or you have cancelled it (please refer to Returns and refunds).
2.2 The Shopping Cart can be used to identify and correct any input errors. Items can be individually removed and the quantity altered from the Shopping Cart before submitting the order. It is your responsibility to ensure all details are correct before proceeding.
2.3 Returning customers can alter their personal details when placing a new order. It is your duty to maintain and update the personal data to keep it true, accurate, current and complete.2.4 You are given the opportunity to cancel the order at each step before sending the payment to be processed.
2.5 Out Of Stock Items will be displayed as such next to the individual product. You will also be informed if you try and order above the quantity in stock of a particular product. Beyond what we say on that page, we cannot be more specific about availability. As we process your order, we will inform you by e-mail if any items you order turn out to be unavailable.
2.6 Substitute goods are not provided in place of out of stock items.
2.7 All orders for goods and services must have a total equal to or above the value of £5.
2.8 It is possible for you to view your previous orders directly from the website by selecting ‘Review Previous Order’ found under the 'My Account' option. However, from time to time as part of ongoing house keeping older orders may be cleared off the system therefore, please print out each order acknowledgement for your own records.
2.9 We have made every effort to reproduce colours on the website as accurately as possible. However, different computers reproduce colours slightly differently and we therefore cannot and do not guarantee that the on-screen colours of any of our products will exactly match the colour of the product itself. You are advised, therefore, to treat on-screen colours as being indicative only of the actual colour of our products.
3. Payment & Prices
3.1 We take payment from your card at the time we receive your order and once we have checked your card details, or if paying by an offline method once the cheque/postal order has cleared. Goods are subject to availability. In the event that we are unable to supply the goods, we will inform you of this as soon as possible. A full refund will be given where you have already paid for the goods.
3.2 The price you pay is the price displayed on this website at the time we receive your order apart from the following exception:
3.2.1 While we try and ensure that all prices on our website are accurate, errors may occur. If we discover an error in the price of goods you have ordered, we shall have the right to refuse to meet or to cancel any orders placed for that product or service whether or not the order has been confirmed and your credit card charged. We will inform you as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund. If your credit card has already been charged for the purchase and your order is cancelled, we shall immediately issue a credit to your credit card account in the amount of the charge.
3.4 Offline payment can be made via; -
3.4.1 International Money Orders: - International Money Orders (IMO) are only accepted in UK Currency (GBP).
3.4.2 Cheques - UK only, must be in UK Currency (GBP). We do not dispatch the goods until the payment has cleared, so cheque orders take a little longer than credit/debit card or cash. Please make payments out to 'EveryBod Fitness'
3.4.3 Postal Orders - UK only, must be in UK Currency (GBP). We do not dispatch the goods until the payment has cleared, so Postal Orders orders take a little longer than credit/debit card or cash. Please make payments out to 'EveryBod Fitness'
3.4.4 Cash - We accept UK currency (GBP) only. Cash must be concealed and is sent at your own risk. EveryBod Fitness take no responsibility for cash that goes missing and does not arrive. Goods are only dispactached if the cash reaches us.
All transactions are in GBP (£).
3.5 Prices on display [are inclusive of VAT] exclude delivery and shipping charges.
3.6 EveryBod Fitness is not VAT registered so prices are not subject to this tax.
4. Delivery & Shipping
Your shipping fee will depend on the weight of your parcel and your delivery location. On placing an order the shipping charge will be automatically calculated and presented to you before you are asked to submit your credit/debit card details.
4.1 Goods are shipped to the address of the registered credit card user only.
4.2 All goods delivered to the UK must be signed for on delivery by an adult aged 18 years or over.
4.3 Delivery times quoted are estimates only and all deliveries are subject to the goods being in stock and being able to obtain payment successfully. However, unless we have agreed a longer period for delivery with you, we will either deliver goods and/or services within thirty days of you placing the order or we will let you know as soon as it will not be possible to meet this obligation. If we do let you know then we will either agree a new time for delivery with you or, at your request, refund any monies paid by you in respect of the delayed goods/services.
4.4 EveryBod Fitness shall not be liable for any delays caused whether directly or indirectly by circumstances beyond its reasonable control except to the extent caused wilfully or negligently by EveryBod Fitness.
4.3.1 The expected delivery time for the UK is 3 to 5 days
4.3.2 Deliveries to Ireland and the rest of the European Union can take as little as 2 working days, however, please allow for up to 10 working days.
4.3.3 For deliveries for the rest of the world you can usually expect 10-14 days.
4.4 We will not be held responsible for any delay or failure to comply with our obligations under these conditions if the delay or failure arises from any cause that is beyond our reasonable control. This condition does not affect your statutory rights.
4.5 If the courier attempts delivery at the shipping address and the customer is not there we are unable to refund the shipping difference.
4.6 Your order may be subject to import duties and taxes that are levied once the package reaches your country. Any additional charges for customs clearance must be borne by you; we have no control over these charges and cannot predict what they may be. Customs policies vary widely from country to country, so you should contact your local customs office for further information.
4.7 EveryBod Fitness shall not be liable for any direct, indirect or consequential loss (all three of which terms include, without limitation, loss of profits, loss of business, depletion of goodwill and like loss, costs and damages, charges or expenses) caused directly or indirectly by any delay in the delivery of an order, even if caused by our negligence.
5. Returns & Refunds
We want you to be completely happy with everything you buy from EveryBod Fitness, so we're here to help, even after you've got your shopping home. For most of our products EveryBod Fitness operate a 7 day money-back guarantee!1. On receipt of goods and services please make sure that you check your items carefully and report an issues or concerns straight away.
All sizes and measurements are approximate but we do try to make sure that they are as accurate as possible.
Within your return parcel please clearly include your name, address and order number and state the reason for returning the goods (this is important so we can work out how to make the EveryBod Fitness shopping experience better for you).
5.1 General Returns Information1
In agreeing to the Terms & Conditions, you are agreeing to take responsibility for returning the goods* back to EveryBod Fitness within thirty days of notification and you agree to take reasonable care of the goods in the meantime.
Please ensure that you pack the relevant item(s) securely and in suitable packaging.
* = If you are a UK customer it is good idea to ask the Post Office™ for a free certificate of posting when you post your mail. For your protection, we recommend that you use a recorded-delivery service if the value of the return is more than 50 GBP.
5.2 Unwanted Items
5.2.1 Most unused and unopened items will be refunded within a maximum thirty days provided notification is given within 7 days from delivery of the goods and the terms and conditions are met. This will cancel any credit agreement, which was signed to fund the purchase. However, please carefully check our list of exemptions, which apply by virtue of the Consumer Protection (Distance Selling) Regulations 2000. The cancellation notice should be sent by e-mail to EveryBod Fitness at [email@example.com] and must state your name, contact details and a description of the goods or services concerned, order number and the reason for wanting to return the item.
5.2.2 The item must be returned to us within 30 days of receipt. If goods are not returned within this time scale you must pay the cost of EveryBod Fitness recovering them.
5.2.3 You must return items in full and original condition.
5.2.4 We will not refund the cost of shipping for returning unwanted items
5.2.5 We are not responsible for packages not received.
5.2.6 You may cancel an order for Advertisements and other chargeable services placed on the website within seven days of the date of purchase, unless the services begin sooner.
5.3 Wrong Items Received
We will refund any shipping costs you incur provided that the item is in new and unused condition when we receive it and you have followed our return instructions. The item must be returned to us within 30 days of receipt.
Please allow us 14 days from the point we have received the product to process your return. In most cases we are able to process returns in much shorter time.
5.4 Faulty Products
5.4.1 If you return your item(s) within 30 days we'll usually offer you a refund, replacement or repair. This is providing that the fault is not the result of misuse or wear and tear (see the below section for more information on faults due to misuse and wear and tear).
5.4.2 Faulty products that were purchased over 30 days ago, but less than 90 days ago can only be replaced or repaired - we cannot issue refunds for products that were purchased more than 30 days ago.
5.4.3 We cannot make refunds or despatch a replacement item unless we have received the faulty item back and inspected its condition. Please allow us 14 days from the point we have received the product to process your return. In most cases we are able to process returns in much shorter time.
5.4.4 We will cover the costs of you returning a faulty item to us (if applicable) provided that you have returned the item in accordance with our instructions. We cannot cover the cost of international returns.
5.4.5 If the product is not available for replacement and cannot be repaired we may either substitute it with a model of equal or higher value (if purchased over 30 and less than 90 days ago) or refund the cost of the item (if purchased within the last 30 days).
5.4.6 We cannot replace or refund items that are outside their warranty period, which is 90 days unless you are instructed otherwise. However, we will do our best to assist you in finding a suitable replacement.
5.4.7 Faulty Products that appear to be in full working order when inspected by our Returns team will result in our Returns team calling you or email you to request more information so that they try to replicate the problem. If we cannot get in touch with you, we will hold the item for a maximum of 30 days before disposing the item.
5.4.8 If the product is found to be working fine we will return it to you provided you are happy to incur the administration fee of £5 plus shipping costs.
5.5 Faulty items due to Misuse or Wear & Tear
5.5.1 We will not replace or issue a refund for a misused product, or if the fault is due to everyday wear and tear.
5.5.2 We will return the original item back to you if you are happy to incur the administration fee of £5 plus shipping costs.
5.5.3 We will hold the product for a maximum of 30 days, after this period we will dispose the item.
5.5.4 We will not refund the cost of shipping the order to you.
5.5.5 We will not refund the cost of shipping for returning Faulty items to use due to Misuse or wear & Tear.
1Exemptions on the right to cancel:
We regret that we cannot accept cancellations of contracts for any of the following;-
- THE PURCHASE OF VIDEO, DVD, AUDIO WHERE THE ITEM HAS BEEN UNSEALED BY YOU (UNLESS THE ITEM IS FAULTY).
- THE SUPPLY OF FANZINES, MAGAZINES OR ANY OTHER PERIODICALS.
- GOODS MADE TO YOUR SPECIFICATION OR CLEARLY PERSONALISED.
- PLEASE NOTE THAT ALL CLASS BOOKINS THAT OCCUR ON A SPECIFIC DAY(S) ARE EXCLUDED FROM THE STATUTORY INFORMATION AND CANCELLATION PROVISIONS.
- ADVERTISEMENTS AND OTHER CHARGEABLE SERVICES PLACED ON THE WEBSITE CANNOT BE CANCELLED AFTER 7 DAYS FROM ORDERING OR ONCE THE SERVICE BEGINS.
6. Class & Event bookins
EveryBod Fitness bookings are sold subject to the management’s right to alter or vary the programme due to events or circumstances beyond its control without being obliged to refund monies or exchange class bookings. Therefore as part of the Terms of purchasing tickets through EveryBod Fitness we regret that we cannot exchange, refund or transfer class booking unless the event in question has been cancelled or rescheduled. Policies set by our partners such as venues and promoters may prohibit us from issuing exchanges or refunds after a purchase has been made or for lost, stolen, damaged or destroyed tickets. [Please note that in the event of any conflict between our ticket sales terms and conditions and those of the ticket promoter’s, their terms and conditions will prevail and we will attempt to notify you of such conflicts before you commit to your order.] When you receive your tickets, please keep them in a safe place, and avoid leaving them in direct sunlight.
EveryBod Fitness agrees to use its best efforts to procure class bookings, prior to the date of the event.
Orders will not be processed until payment has been received in full. We will contact you by telephone, email or in writing if your payment is unsuccessful. In some cases EveryBod Fitness will only accept class bookings from the UK, we reserve the right to cancel orders made by any person in a country outside the UK without prior notice.
Class bookings may be restricted to a maximum number per person, per credit/debit card or per household. We reserve the right to cancel bookings without prior notice if purchased in excess of such a limit.
Class bookings made through everybod.co.uk may be subject to a per booking service charge and a non-refundable per order processing fee which will be notified to you before you place an order.
6.1 Cancelled Events In the event of the cancellation of an event by the organiser/promoter (e.g. a cancellation due to circumstances beyond EveryBod Fitness’s control), EveryBod Fitness will only refund the face value of the ticket. If the event is cancelled please allow us 14 (fourteen) days from the point we have had this confirmed by the event organisers to issue a refund. In most cases we are able to process refunds more quickly.
EveryBod Fitness will use reasonable endeavours to contact you either by telephone, email or in writing (using the details provided at the time of ordering) and advise you of the cancellation. Please note, however, that it is the customer's responsibility to check whether the event is going ahead at the scheduled date, time and venue, and EveryBod Fitness cannot guarantee that they will inform the customer of any changes to the event date, time or venue.
6.2 Event Alterations If a class or event is moved from its advertised venue and / or the date is changed, bookings already made may remain valid should the customer wish to attend the revised class/event. If not, EveryBod Fitness will refund the face value of the tickets. If some members of your party still wish to attend please enclose a note informing us of this and we'll be in touch to rebook these for you. EveryBod Fitness will notify all purchasers by telephone, email or in writing (using the details provided at the time of ordering) to advise on the validity of the tickets and the procedure for obtaining a refund.
In the event of a change at short notice (within 1 week of the event) EveryBod Fitness will notify purchasers of the conditions that apply, and offer a refund if these are not agreeable. Please note, however, it is the customer's responsibility to check whether the event is going ahead at the scheduled date, time and venue, and EveryBod Fitness cannot guarantee that they will inform the customer of any changes to the event date, time or venue.
In the unlikely event that the price of a ticket for the event increases, EveryBod Fitness will inform you by telephone, email or in writing and you will have the opportunity to pay the increase in price, or request a refund.
6.3 Class /Event booking Refunds with Booking Fees Refunds, including booking fees will be issued if EveryBod Fitness is unable to fulfil an order for any of these reasons:
6.3.1 EveryBod Fitness was prevented from using the venue;
6.3.2 EveryBod Fitness do not run the class/event (due to events such as extreme weather or illness);
6.3.3 EveryBod Fitness booked the in for the incorrect class/event order, i.e. wrong event;
6.3.4 Any other similar circumstances where EveryBod Fitness has acted with negligence or where we may have acted in breach of contract.
6.4 Class Booking Policy
All bookings are subject to availability. A refund will be issued if delivery cannot be made due to unavailability.
You will be provided with an email on completion of placing the class booking. Customers are advised to check their purchase upon receipt as mistakes cannot always be rectified. It is the responsibility of the customer to inform EveryBod Fitness of any change of address, contact telephone number or email address, both before and after receipt of the goods. Please note that our preferred method of contact for customers booking online is by email, so care should be taken to provide a current, valid email address.
EveryBod Fitness reserves the right to cancel class and event bookings which it reasonably suspects to have been made fraudulently.
By ordering you agree that the bookings are for the personal use of you and your party only, and will not be resold or transferred. Any resale or attempt to resell the tickets at a price higher than purchased will result in your orders being cancelled without prior notification.
Some events impose an age restriction. If an event is specified on www.everybod.co.uk for over 18's only, no refunds will be issued to ticket holders under the age of 18. EveryBod Fitness also recommends checking in advance.
For disabled access enquiries for any of the events please contact the venue before placing an order.
6.5 Ticket Terms
6.5.1 Each ticket is issued subject to the Rules and Regulations of the venue.
6.5.2 The right to admission to an event is reserved by the promoter and event venue, who may take health and safety, environmental and security concerns into account at their reasonable discretion, and may from time to time carry out security searches.
6.5.3 EveryBod Fitness would advise customers that no refunds will be offered to customers who are refused entry or ejected from a venue on account of late arrival, being (or appearing to be) under age (we will endeavour to advise of any age restriction, but recommend you check with the venue first and where appropriate carry proof of id), declining to be searched, abusive, threatening, drunken or other antisocial behaviour (including smoking in no smoking areas), carrying offensive weapons or illegal substances, or making unauthorised audio, video or photographic recordings.
6.5.4 If a booking is re-sold or transferred for profit or commercial gain by anyone other than the promoter, venue Management, EveryBod Fitness or one of their authorised sub-agents, it may be voided and the holder may be refused entry to, or ejected from the venue.
6.5.5 The venue may operate a No Smoking policy, any such rules must be followed.
6.5.6 The unauthorised use of photographic and recording equipment may be prohibited. Tapes or films may be destroyed. Laser pens, mobile telephones, dogs (except guide dogs) and patron’s own food and drink may also be prohibited (please check with the venue).
6.5.7 The Promoter, venue Management and EveryBod Fitness accept no responsibility for any personal property.
6.5.8 The promoter or venue Management may not allow pass-outs or re-admissions of any kind. Please check with the venue first.
6.5.9 Ticket holders consent to filming and sound recording as members of the audience.
7. Liability and Indemnity
7.1 Nothing in these terms and conditions excludes or limits liability for death caused by negligence, fraudulent misrepresentation, or any other liability that may not otherwise be limited or excluded under applicable law.
7.2 EveryBod Fitness will use reasonable endeavours to verify the accuracy of any information on the site but makes no representation, undertakings or warranty of any kind express or implied statutory or otherwise regarding the contents or availability of the site or that it will be timely or error-free, that defects will be corrected, or that the site or the server that makes it available are free of viruses or bugs or represents the full functionality, accuracy and reliability of the website. EveryBod Fitness will not be responsible or liable to you for any loss of content or material uploaded or transmitted through the website and EveryBod Fitness accepts no liability of any kind for any loss or damage from action taken or taken in reliance, completeness or fitness on material or information contained on the site.
7.3 EveryBod Fitness will not be liable whether in contract, tort (including, without limitation, negligence) pre-contract or other representations (other than fraudulent or negligent misrepresentations) or otherwise for any: economic losses (including without limitation loss of revenues, data, profits, contracts, business or anticipated savings); or loss of goodwill or reputation; or special or indirect losses suffered or incurred by that party arising out of or in connection with the provisions of any matter under these terms and conditions.
7.4 We make no warranties, representations or undertakings about use and contents of emails sent and received by people signed up for our un-moderated mailing lists (mailing list where all recipients can reply). If at any point you wish to be removed from any of our mailing lists, please send an email to firstname.lastname@example.org with the word 'remove' in the subject line and the email address that you wish to be removed within the email. Please note that it may take up to 28 days to action your request.
7.5 We will take all reasonable precautions to keep the details of your order and payment secure, but, unless we are directly negligent, we cannot be held liable for any losses caused as a result of unauthorised access to information provided by you.
7.6 EveryBod Fitness does not endorse or approve the content of any 3rd party site, including those referred to or accessed by hypertext link through this web site nor will EveryBod Fitness have any liability in connection with any of them (including, but not limited to, liability arising out of any allegation that the content of any 3rd party site infringes any law or the rights of any person or entity).
7.7 EveryBod Fitness are not liable for any 3rd party damages in areas such as advertising including IP infringement.
8. Website Access, Use and Contents
You acknowledge and agree that all copyright, trademarks and all other intellectual property rights in all materials and/or content made available as part of your use of this website shall remain at all times vested in us. You are permitted to use this material only as expressly authorised by us. You further acknowledge that without consent any other use of the material and content of this website is strictly prohibited. (further details under the Copyright Statement).
We will do our utmost to ensure that availability of the website will be continuous and that transmissions will be error-free. However, due to the nature of the Internet, this cannot be guaranteed. Also, your access to the website may also be occasionally interrupted to allow for repairs, maintenance, or the introduction of new facilities or services.
Users of this website may post via the Contact Us as long as the content is not illegal, abusive, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties, or objectionable and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of "spam."

By submitting a review you are granting EveryBod Fitness copyright ownership to the text.
When you visit the website or send e-mails to us, you are communicating with us electronically. We communicate with you by e-mail or by posting notices on the website. 9. Advertisement Regulations
EveryBod Fitness are not liable for any 3rd party damages including IP infringement.
The below terms apply to the individual / company placing an order for advertising space on the website.
Advert images may be jpg, gif or Flash (swf). If Flash, the url must be embedded in the file. The image must be less than 60k in file size. You must provide the url and a description.
9.1 It is your obligation to comply by any relevant advertising codes and regulations.
9.2 As well as complying with formal legislation, you must also have regard to regimes of self-regulation dealing with misleading advertising and unfair competition.
9.3 You must have the authority to place an advert for the product/service/website you plan to advertise on EveryBod Fitness.
9.4 It is your responsibility to check the advert for accuracy before and during inclusion on the website.
9.5 You must provide us with any changes to the URL.
9.6 You are responsible for maintaining a back-up copy of the advert
9.7 Adverts must not contain any political reference, and may not link to political websites.
9.8 EveryBod Fitness reserves the right to not to accept the Advertisement should they choose.
9.9 EveryBod Fitness reserves the right to remove any advert that is deemed to be falsely advertising, where the content is not as originally stated or where payment is not received within the agreed time scale.
9.10 Position and exact page is down to our discretion. You will receive written confirmation if there is a requirement for the advert to move page.
9.11 Adverts are charged at a flat rate rather than pay per click. Accepted advertisements will be placed on the website within 7 days of receipt of payment. Please get in touch for details on how to make a payment.
9.12 EveryBod Fitness reserves the right to review Advertising charges on a regular basis. If following this review it is decided to vary the Advertising charges written notification will be made to the Advertiser as soon as possible. In the event of an increase in the charges the Advertiser will have the option to cancel the Contract provided EveryBod Fitness receives written confirmation of this from the Advertiser within 14 days of the date of the notification of the change of price. If no such notification is received from the Advertiser within this period then the Advertiser will be deemed to have accepted the change of price; and be invoiced at the higher price effective from the date of notification of the increase.
9.13 Any advert designed and created for free by EveryBod Fitness remains the sole property of EveryBod Fitness and therefore cannot be used elsewhere.

If you find any product or service supplied by EveryBod Fitness below standard please report this in the first instance to us by email.
If you feel you fail to get a satisfactory reply please contact your local Trading Standards Office for further advice.
